Port of Melbourne is Australia’s largest capital city container and general cargo port, handling more than one-third of the nation’s container trade. Port of Melbourne operates as a port landlord and manages around 500 hectares of port land and 21 kilometre of waterfront.

About the role

Port of Melbourne has an outstanding opportunity for an experienced property lawyer to join the established legal team as Senior Legal Counsel. Reporting to the General Counsel, and joining a high-calibre in-house legal team, you will work collaboratively as a member of Legal Services in ensuring that Port of Melbourne’s operations as a landlord port are conducted within the prescribed legal and statutory framework and that its rights are fully protected by the provision of quality legal counsel, risk management and good governance.

You will be involved in negotiations with large commercial entities that perform a critical role in supply chain. This will include negotiating long term ground leases with tenants that are making substantial investments in improvements having regard to Port of Melbourne’s upstream obligations as tenant under the port lease transaction documents and regulatory framework. The role will also involve regular engagement across all areas of the business for the purposes of drafting and negotiating.

  • short term leases and licences to accommodate the operational requirements of port tenants;
  • deeds of extension and variation of leases;
  • licence arrangements for access to wharves on a preferential or common user basis;
  • access authorities for short term access to port land by port users and the wider community;
  • tenant development requests in line with Port of Melbourne procedures for works consent; and
  • right of entry deeds and landlord consent deeds required by tenant financiers.

Your role within the legal team will be end to end, from assisting with strategic advice at the Heads of Agreement stage through to finalising Board papers. You will be joining a business of approximately 120 staff with regular engagement and reporting  to members of the Executive Leadership Team, including the CEO. The role will also involve some broader general commercial and contractual work, as well as working with the environmental team to provide advice on the general environment duty under the new environmental regime in Victoria.

About you

  • Senior Associate or equivalent level in-house experience within a law firm property team or in-house property environment
  • Superior interperpersonal and stakeholder management skills
  • Ability to identify key risks, highlighting issues and providing solutions
  • Excellent communication skills both verbal and written, with the capacity to influence
  • Ability to provide legal advice and assistance to internal clients in a timely and commercially astute manner
